IEP HELP

I need to know if I have more rights or if I'm stuck with what was offered..

It was written that my son get one 30 minute session of OT every week.
And two 30 minute sessions of speech every week.

I was told that OT is available Wed and speech is available Wed. No problem.

This is my problem: The speech therapist said she is only available on Friday's at his school for that second session. Which will not work because he has a combined private session of OT and ST with another little girl using AUG COMM devices for interaction and training him to use it. Followed straight away by a private OT session by himself. And she is not available later in the afternoon after we are back in our town (his therapy is over at 11am and we are 45 minutes out, so it would need to be 12pm or later so we can be there on time).
Is that legal for her to say, 11am is my only opening on Friday so if you can't make it, he is only going to be able to get one session?

It is legal if it only says how much he should get, they can provide a time and if parents can't take it then it is not seen as the school not complying with the iep but the parent. If it gives specific dates then yes illegal.

So it is legal because I can't make the second session they are offering? Would it be easier if I wrote the IEP thing relevant for speech so you can read it?

Sorta. It's really tricky. Sure- that should help!

Contact the company she works for and talk to them about it. 3 of my children receive services and they work it out the best the can...When my younger son wasn't in school they came out to the house and when he started school they went out to the school. The also see my other kids at the school. I know they do some in groups and some individual but if the therapist cannot do the scheduled times on the IEP the send another person from the company to do it.

Oh, okay. Yes. They are very confusing. I wish it was easier to navigate.

Ok. If you were to try and fight it legally they could probably get away saying we are offering you the service but you are not making it. This is so hard because it can be said that they he to try hard to get him services. Best thing to do is to try and get them to work with you some way. Explain the situation. See if they can add a group session/ cancelation list/ different st. I wish I could help more but it's hard without seeing it. :-(

Okay. Thank you for the help you could offer. I'm a little frustrated that is all they are offering.  We've had prior obligations for a year. It seems like she would be willing to rotate a kid from the afternoon in school to the morning slot. Or to her Wed. openings? I might call the ARC. if she won't budge. I'm the squeeky wheel.
