Divorce question..

My SO is still technically married but they've been estranged since January 2010. The child is in the custody of the grandparents bc SO is moving to the state AND ha had no steady home or job in 9 months. For the divorce, can they annul or will it be more complicated? I'm confused how this works.. Nothing rude because it won't help you or me. Thank you.

I think it's past an annulment deadline. That's for people who get drunk in vegas and wake up married to a stranger lol.

It will be divorce. They're will be TONS of paperwork and divorce fees. Some state require that you're LEGALLY separated fr up to one war before they will do a divorce.

Luckily neither state requires that. Maybe annul was the wrong word. I have no idea lol. Thanks! And yeah, Vegas drunken marriage would suck. Haha.

You have up to one year to annul a marriage so yep divorce it will be.

In NY it' doesn't matter if you're married 8 minutes or 8 years. There is not such thing as annulment

Will it be shorter now that technically neither of them have custody? The grandparents will split it with my SO when he moves down there (3weeks) but it won't be documented with a judge right away. There's only debt to cut in half. They have nothing else..

When I got divorced we wrote our parenting plan, had no lawyers, wrote out what each was taking and who got what debt. All that we paid was a little under $200 dollars for court fees and filing fees. That's it. As long as they can get along about things just find and print of the documents from online and submit them. Pay the fee to submit them and you are good, show up to the case and DONE.

...he sounds like a winner. I know that's rude, but really? Married, no job, can't take care of his child. Are you serious?

I'm not Catholic but I had a friend that is Catholic that was marrying a guy that had been married before and was divorced. In order to marry in the Catholic church they required an annulment in addition to a divorce to recognize it as a Catholic wedding since they consider marriage a sacrament. It was more money and a pain to do but she wanted to get married in the Catholic church so they did it.
I'm glad I'm not Catholic.

They're two different things. Annulments in the Catholic Church are for the Church alone. There is also such a thing as a legal annulment, which means that legally the marriage never existed and that is for things like proof of fraud, marrying someone underage, etc. The latter is done through the courts. I know it's confusing--one of them needs to call it something different, lol.
