Okay so my little sisters sons dad got arrested Friday night for DWI ( he said he quit so she's very pissed ) and his family was trying to bond him out but they said he has an IMS hold on him . We didn't know he wasn't a citizen here since he had a real job and all so no crap please ! Does anyone know if there's any possible way to make sure he doesn't get deported ? They weren't together but a couple months and they weren't together for over a year and a half but had just started trying to see if they could be a couple and we don't want little man to lose his daddy since he is actually involved in his life and helping my sister out right now since she doesn't have a job !

I don't think so. Even if he was a legal permanent resident he'd still have a chance of being deported for any illegal activities. They're pretty strict when it comes to non citizens, we have far less rights, even as a LPR. An illegal has practically zero.

Is he in jail right now?Will he be transferred to immigration? If so YES,you can get him out.

Laws have changed ALOT since June or July.I know this because I've been through this last year.But my husband didn't have a DWI.

Yeah he's in jail they won't bond him out because they said he already has a hold on him so it'd be pointless to take their money then him just go straight over to IMS .

Yup,when my husband was in jail I had to pay 2,500 so they can transfer him to immigration then pay 5,000 bond to get him out!


The reason why I payed the jail bond was because if I didn't they where going to hold him longer in their,like 5 or 6 months then transfer him.So right when I payed them he was transferred.

my cousins husband had to wait a month to get out, but he didnt get deported. your going have to get a lawyer.

Is it in Houston? If it is, I think that is a safe place. Like if illegals get caught driving in Austin, they can't be deported. Just look more into it. If it's a felony, it might. I know three strikes they can.

Yeah it's Houston but she said she believes the lady was trying to tell her this is his 3rd one ( she doesn't understand any Spanish and his family doesn't speak good English ) .

smh. Then he might very likely be deported back. I know a friend of mine's husband got caught with with weed three times, only misdemiors (spelling??), and he was deported back. This was a small town outside of Austin though or it could of been in Austin. I'm sorry y'all have to go through this. =/ That sucks.

OP if you still need help with this you can contact a lawyer about a request to cancel deportation. Depending on laws in your state about crimes, they will sometimes consider it. There is no sure way to keep him from being deported, even if he does get bailed out, unless he doesn't show at court and that's not a good plan. Finding a lawyer as quickly as possible is a good idea, and also make sure he hasn't signed the voluntary removal form, which is his consent to go ahead and be deported, regardless of what is decided.

I don't think he's signed that one of his family members is coming to get my sister to go talk to someone . They said they can't send him to IMS because he won't sign the paper but she didn't know what paper they were talking about so maybe that's it !
