Moving in With SO Legally

My son who is 16 & his girlfriend who is 15 are pregnant, due Apr 3 if not sooner. She wants to move in with us so they can raise the baby together but her dad has been against it. She talked to him last night or this morning & he told her that if she moved in with us that he would not be in her or the baby's life anymore. At this point she really doesn't care because they want to do what is best for them & the baby. If you left to move in with your SO & their family or got kicked out & moved in with them, how did you go about them getting guardianship or you not getting in trouble with the law? We're trying to do things legally & I have talked to a lawyer & I think I'm going to call her again tomorrow with the new info. But with her dad not consenting for us to be her guardians, we can't do anything but call cps for the way things are there which she will be put in a foster home instead which we don't want. I feel we are up against the wall no matter what unless we get her dad to sign guardianship to us. Any of you who have been there have any help for us? I'd really appreciate it.

She could get emancipated...but honestly...I know they want to live together but they are 15 and 16. I would want my pregnant 15 year old home with me too.

She can file for emancipation. Calling CPS just because the father doesn't want her to live with her underage boyfriend after getting pregnant is just crappy. You cannot make the father consent to anything.

How do you know this is Angela? Sounds like a legit question.

What is CPS going to do? That's a waste of time. I'm not sure why they can't parent well in two separate homes...

You're right...this sounds legit.

If her father refuses to sign his rights over then unless she's beaing mistreated there's nothing you can do really. She's 15 & he could just have her brought back home legally & you could get in trouble for kidnapping or harboring a runaway(I ran away at 15 because my mother threatened to throw me down the stairs & cops came & got me & took me to the d-home so she could come get me)

No, that's not the reason to call cps, there's more to it than that I just don't want to get into the nitty gritty but that's what the lawyer told me to do hearing the whole situation with how things are at her home.

I don't think we have emancipation here in Indiana but that is one thing I have been trying to get more info on. That's something I need to ask the lawyer about.

If you have enough actual reason to call CPS, then that's your business. Look to see about the emancipation in your state. That's all you can do right now unless you really want her going into a foster home, which I would not.

I'd be careful though I had a friend in Ohio who was 16 (legal age of consent) who had sex with his 15 year old girl friend and almost got charged with rape for it. Idk the law in Indiana but you might wanna be sure you're not setting yourself up for something worse if you get the law involved.
