signing over rights

My soon to be ex husband has decided he doesn't want to see his daughter or pay child support on her. I have agreed to this because he is an awful person and cheated on me with some crazy bitch that threatened to kidnap my daughter called me her surrogate and beat him up and keyed his truck in a public parking lot. He is refusing to stop talking to her for our daughter's safety and has chosen crazy bitch over his daughter. So he says he will take his name off her birth certificate, sign away his rights, and let me change her last name to my maiden name. My question is has anyone ever done this and is it expensive and even possible?

You have to look up the laws for FL.

NY will not allow it without someone to adopt the child in the other parent's stead, and generally that also requires the custodial parent to be married to the person willing to adopt the child for at least a year.

Yes he can sign his rights over. It is going cost alot if your going to change her last name though , how much I'm really not sure.

I'd start buy going to your towns courthouse and seeing what needs to be done or filed for him to sign over his rights. Good luck, OP.

I tried to look it up and couldn't find anything on it. I called the law library and they said they have a form for it but didn't know what had to be done to do it. We are still married I am working on getting the divorce filed. I don't have anyone else to assume the rights of her father though I want to have full custody with him getting no visitation rights and he doesn't want to pay child support. I also want her name changed to my maiden name. Basically he wants to become nonexistent to her and I kind of want the same thing.

Most the time he would still be on the hook for child support and they dont like to term his rights inless someone is there to adopt. Also to chnage her name it may cost u to change it and then its going to cost for a new birth cer.


I have only seen that u can term them in florida for abandonment.

Go court house and file for divorce and all the other stuff at the same time. The court house will tell you everything you need to do and how much it will cost.

I would start with getting full custody in the divorce agreement, you'll probably have to be divorced before signing away the rights can happen, at least.

But, from what I can find-- FL has the same rules about someone adopting the child in the absent parent's stead in order to sign away parental rights completely.

My SO wanted to do this but they will not let him in the divorce he will have to go back to court to term them the last name they would not allow her to change as well and they ordered child support. If he terms his rights he would still have to pay till someone take on the money part of taking care of her as in adopting her.

Most states won't let a parent sign over rights unless there is someone there willing to adopt the child, and until the child is adopted i've heard they can make the parent pay child support. Only in certain circumstances will they terminate a parents right, and in most cases it's for the safety of the child. You could change her name to your maiden name, but when you start the divorce they still might go after him for child support and if you ever need assistance they'll go after him.

they would not let me SO ex wife change her daughters last name but they let her change her name she went back to her old last name but his daughter has to keep my SO last name.

I know in some cases it can be done, but i think the dad has to agree or something like that.

I know they will let me change her name if he signs the paperwork for me to do it. This is for her safety. It is because the girl he is seeing is a violent person and has threatened violence against me, threatened to kidnap my daughter and harm her, and physically attacked him and left him with 2 black eyes bit him and keyed his truck. She said if she ever saw me or my daughter she would do the same to both of us.

That's someone else causing all that, not your ex. I mean it's his fault but he isn't a threat to your DD, she is, so they may not go for that. I know after so long of no contact you can get him for abandonment.
