adoption of my 3yr old.

on 4/1/09 i had a beautiful 6lb 15oz baby girl! her biological father was in her life for two years but since 4/26/11 he hasnt tried to contact me or my family about her. i am now married to a wonderful man whom she absolutely adores & considers to be her dad. i live in alabama & was wondering about my husband adopting her. i had her name changed a year ago from her father's last name to my maiden name & he didnt fight it so idk if that will make a difference.

Well, his name is on the birth certificate. He doesn't have custody rights, but he does have parental rights or something like that.
She's still his child. If his name wasn't on the birth certificate, it would be different.

regardless of marriage or her birth certificate he still has the right to fight for his rights. I am in a similar situation with my ex. Basically you need to terminate his right to claim rights before she is illegible to be adopted by your husband. A judge has to grant this though. I'd hire a family lawyer if you can, it's mounds of paperwork. Once you get to court though the judge can do it all in one hearing, terminate his rights and grant the adoption providing all the proper paperwork has been filed and is ready to go.

No, it's considered grounds for abandonment. You still have to go to court and have it declared.

My ex isn't on birth cert, dean always had my name, And his dad never signed the declaration of paternity, and still had rights, and got visitation, u need him to sign away his rights to let ur husband adopt her.
