i better get my paycheck!

So I worked at this crappy fast food place for a while and I finally found a better job and I quit my old job on the spot. Well my old manager tells one of the co workers that she isn't giving me my paycheck till I turn in my uniform. Well idk where that uniform is lol and isn't it illegal to keep someone paycheck?? What do I do?

Yes, taht is probably illegal. Why didn't you turn in the uniform like a responsible adult? You should try to find the uniform and turn it in, since you DO owe them that or the money for it. However, no, I don't believe they can hold you check (at least in California) until you do.

I am not sure. It doesn't sound legal but they could take out the cost of the uniform from your check.

If it's in their policy that do that, they can. and they can deduct the cost of the uniform from the check.

A lot of places around here don't have to give you your paycheck until your uniform is turned in. Start looking up if it is legal or not!

when you start working, some places do have you sign a form saying they can hold your last pay check until you turn your uniform/name tag in. i'd avoid the drama and just find your uniform.

Because I just was fed up with them at the time. That doesn't make me irrepressible at all. I mean I payed for the uniform.

an my boss hold back my paycheck? No. No matter what, it's your money. Your boss can't hold your check until you return company property, until you finish a job, or any other reason.
HR may tell a worker that "when you drop off the equipment, you can collect your final check." That suggests you can't have your check unless you return the company property -- but you can. Even so, it's smart to return company property. In the future another company may be calling to ask for a reference (even if you didn't tell them to). If you have something that's worth a lot, the company could also take you to small claims court to get it back.

If you payed for it, then it is YOUR uniform..not theirs

If I payed for that uniform and they never told me I had to give it back when I quit then no it is not irresponsible!

If you paid for it then it's yours. They can't demand it back. Here they have to supply it to you if it has their logo on it (and you don't have to pay). If it doesn't, then you have to buy it, but you keep it. If you paid for it, then it's yours.

But if it *IS* theirs,then yes, it was irresponsible. You had a responsibility to return their property, even if it was a crappy job, and you failed to do that just because. That is irresponsible.

When did you pay for it and do you have proof?

I've never worked in a fast food place before but it's important to read over everything your employer gives you to sign instead of just signing your name because if it was in any paperwork that you signed then you may have to give it back, it's also possible that they reimburse you when you return the uniform in good condition.
