response to custody petition

I'm drafting my response to my bds petition for custody, do I put on there that I would like him to repay my lawyer fees?

Do you have a lawyer? If you do,I would just tell him and have him fight for it.

Why wouldn't he? If he is yaking her to court then he should pay her fees. My father had to pay my mothers because his case was bullsmurf. He also had to pay the divorce fees because he filed for it.

This! He can't even care for them by himself, his mom even agrees with me there, but as son as I filed for child support, he files for custody. Knowing I don't live with my mom and dad and so have no bills, so I have had to sell my childrens and my horses and trailer just to start paying for a lawyer.

So I should just ask for it in court then? Thanks everyone

Yes,I would let my lawyer know I wanted the fees paid. Because not only do you have to pay lawyer fees,you have to pay court costs on top of that.

Thank you. I've been so upset over this since I got the papers. Makes me crazy to even think for a minute that he could get them. The one time he had watched then by himself he was asleep when I finally got ahold of him to come get them, my at the time 1 yr old was eating butter her brother had gotten for her because she was hungry. I just can't imagine them doing that again.

I've just never heard of the father paying the mothers lawyer fees.

Also, OP started filing for CS so she would have had a lawyer anyway.

I wouldn't ask for it but it looks like that is just me

I asked.. but didnt get it.

Because you CHOOSE to have one. Its not mandatory.

My divorce decree says that he has to pay any of my fees if he takes me to court and loses. It was put in there to keep from any frivilous custody/child support lawsuits from happening. Good luck!

I was pretty much told that unless one party is being completely unreasonable, and driving the cost of the process up.. the judge would deny it.

Maybe its just me but i do think hes being completely unreasonable. He has never had them by himself, after the first night, and only filed for custody in response to me filing for child support, which i had to do to keep their insurance. And i hadn't planned on using a lawyer for the child support hearing because I'm just not that worried about the money, hes not helped me out in the 2 years we have been separated I don't care if he helps now lol. but I think I will ask and if i get it great, if not oh well.
