last name & paternity

If I take my daughters father to court to determine paternity get child support and do the whole custody and visitation thing does he have the right to request her name (last name) be changed to his?

I wasn't going to give her his last name and I know he will have an issue with this somewhere down the line. I didn't think he could actually do anything about it.

Uhm, I think he could request it-- but whether it would be granted-- I doubt. Especially if it's not like he has sole custody and the mother has no visitation whatsoever.

Yes he can and a lot of judges will grant it. They see it as his right as a father or some BS like that  .

LO has my last name, her dad didnt like it, but he doesn't have sole custody of her.

No. He can't change her name.

-___- oh man. I mean here is how I look at it ... last names are such a 'serious' thing in my family my oldest has her fathers last name things went bad 2 years in so that ended. Now they ask me if I regret it - which I do not .. other then when I call the doctor and they call me Mrs. ________ NOT MY LAST NAME lol. Its actually not used a whole lot. Now because things didn't work out right off the bat with this one they just keep saying "you are definitely not giving this baby his last name, right!?" .... all because it will be different from mine and from my oldest. BUT either way you look at it when I get married - if i have another child he or she will have another different last name lmao. As my last name will change and I wont be able to give her my new name anyway. im stuck.

My DD has my last name. When I get married, I'm going to hyphenate so that she still has my last name, too.

so then here is an interesting question. Can I hyphenate my oldest last name?

I have full sole custody of her.

Her father has no visitation/legal rights whatsoever? Then I think you can.

Here they can change it very easily. Thats the main reason I chose to hyphenate his last name. Its my last name-bd's last name but my last name is what he'll go by mainly.

Is the father in her life? My mom changed my last name back to hers when I was 9 months old after my father took off. So you can change it if you want.

I don't understand why people are saying that the judge can force you to give the baby the BD's last name. That can't. Flat out. The ONLY way that would happen is if he requested it in a custody order and you didn't contest it.

Her father is in her life 2 days a month. Sometimes 4 if she is lucky. I just want her to have my last name bc if I give this baby my last name I don't want her feeling left out. Maybe I can see if I can get it hyphenated.

I did that and it is a disaster... the plan was to change it to his when we got married... but then he decided to leave and become the scum of the earth... so when I filed for custody I requested to change it to just mine.. I am still waiting on the judgement.

They can not make you change her last name to his just bc he's proven the father and all that. You have a right to give her any name you want since you are not married. If you were married itd be a different story. I would suggest giving ANY kid the mothers last name, ESP if they're not married bc of the exact reasons your having issues with. Then, when you DO get married you CAN change her last name to your new one if you would like! Its harder to get the last name changed back to yours after you give her the fathers last name then it is to change it to something else later on if she has had your last name the entire time.... if that makes any sense. lol.
