can they do that?

So DH has a loan through Genesis. For the month of September his payment fell on a day we just couldnt make the payment, so MIL offered to pay it for us so it wouldnt be late and we could just pay her back the amount. She paid it almost a week before it was due, and she paid the full amount. Now I never check my account unless im putting money in or taking it out. But since I was going to get gas today and I didnt want to overdraw my account, I wanted to see how much was in there. My account was already negative $251.75. I thought it must be a mistake, since I made it so I cant overdraw my account, if the money isnt there it wont let me take the money out or use my card at all. So I check my account history to see what was going on, and it says that I used my card for DH's Genesis loan, and then there are the ridiculous amount of overdraft fees and fees from both Genesis and my bank for "bouncing a check". So I call MIL, who works at the credit union I use and she looks into my account, and DH's loan people went ahead and pulled a payment out of my account the day after MIL made the payment on the 13th, even though the account wasn't even due till the 17th. Im on hold with them right now, but how can they just take the payment out of my account like that, ESPECIALLY since we had already paid them the day before and his account wasn't past due? I always pay online and I never signed anything authorizing them to automatically take money out of my account, so they shouldn't have been able to just take money out correct? MIL says the only way she knows is if me or DH authorized a payment, but neither of us did.  

if you didn't authorize auto payments they cannot do that.

Happened to me once it will say negative and then the money will go back in with a fee of 40$ since the money was not in there for the payment

  So not only should they release the money they took, they also need to pay the overdraft fees. I'd be livid.

Im just so mad. So now we have to wait 4-6 weeks for them to process our claim. So im overdrawn and instead of paying our bills this month Im going to be paying off these late fees.

Oh I have been. Ive been talking to every supervisor I can get a hold of. Hell even if I did authorize a payment im not sure how they could just take the money after we made the payment on time. But im supposed to be getting another call tomorrow morning to speak to someone else about this because I dont have time to wait 4-6 weeks for them to pay my money back because of their mistake.
