Work Discrimination
posted 3rd Oct
I work at walmart and I was told after having my doctor fill out all the paper work stating that I do not need a leave of absence but I will be on a 20 pound lifting restriction that Walmart cannot accomodate me and I will either have to continue working and lifting in unsafe conditions or quit because it's my personal choice to keep the baby. Another girl who just had her baby 2 weeks ago that was in the same department as me has been accommodated for her pregnancy and was not force to make this decision....
what should I do?

Call HQ, the BBB, anyone above whatever manager is not going to accommodate you.... are you a full time employee???

That's hard because in my state if you can not perform your job they can fire you...

Major lawsuit if they do not comply don't you have a workers board in your state they will assist you

If they already accommodated another pregnant woman then they have already set precedent and must continue in that way. Are they unionized? Whoever told you that they would not accommodate you I would go above their heads. Better yet I would go to the person who accommodated the other pregnant lady and speak with them. If that doesn't work getting loud about it may help...let others know what is happening, that you are being discriminated against and that may change their tune. Bad PR isn't good for a chain like Walmart.

They should definitely accommodate you, especially if they did so for another worker. Talk to someone higher than the person who refuses to accommodate you. I also work at Walmart, and honestly I'd say just leave if you can and find something else. It's not the best place to work.

They need to accomodate in someway.. In my job I called the high up bosses to complain that my manager would not let me have a stool while working 12-14 hours on cash.
I was working in the warehouse but could no longer lift, as my pregnancy was already having complications from the start. So they moved me to cash to accomodate that, but would not allow me to sit EVER. and I was getting dizzy and passing out and my manager is a bitch and threw a hissy fit once and grabbed the stool from under me and threw it across the room.
I snapped and called the labor board and then went to corporate (sp?) and filed a complaint. Needless to say my manger tried to have me fired and lost her job instead. I am a valued employee and even though my actual boss does not even live In Ontario they valued me more then the manager. lol
They cant not accomodate you at all. I am not sure how it works where you are but here, you can refuse to do your shifts til they accomodate your needs (for your health and safety as well as babies) and they have to pay you for your lost shifts till they accomodate you...kwim?

t my job I do heavy lifting and i was told that in my job discription that i am required to lift above 65 pounds an if i can not do so then i am not able to do the job so I wouldnt be able tocome back untili can. So if thats the whole pregnancy then i wouldnt have a job.

I worked for Walmart and got pregnant while out side in the tire and lube department. They can not accommodate you. Talk to them about moving to a different department. I switched inside to customer service and had no issue at all.

i agree you need to call higher ups. unfortunatly my work (i am a cna) i have to lift people and help them sit up in bed and roll them in bed...some weighing up to 300lbs...talked to my dr yesterday (am 33 wks today) and he wanted to write me off lifting...if i cant lift i cant work, my work will not put me on modified unless i am hurt at work..stupid indiana laws! so he wants to see me in a week and will possibly take me off work. i can't believe you are having baby and going right back to work..not even a couple weeks off! i have 8wks scheduled off! but im having a c-section

I know how you feel there... I keep thinking the same thing. If i get any resictions I have to go on leave. But in other departments they accomidate for them. I don't get that.. but.. I'll have to see how it goes and hopefully I don't lose my position.

Not sure if your working in a walmart in the states or in cananda, but im a manager at a walmart in canada(im also on the safety team, not sure if you have one of those their either), and when they hire you, and when you go through any training they do state that you have the right to refuse unsafe work or conditions, and im sure its like that with any company, if not id try talking to someone about labour laws, because this doesnt sound right... Im just over 4 months pregnant and i work in toys, with bikes and lots of heavy stuff and they should have no problem that you can't lift certain things, i mean you are a woman so technically you cant lift things that are to heavy anyways.
I would try talking to the store manager, or district manager if you have to because this sounds like bullsmurf to me,.
