Depending on your state-you should be able to just amend the cert, since its just 1 letter different. With a SS that shows one name, and a BC that shows another-most courts will change it. I would suggest looking up your states BC amendment paperwork, submitting it, and seeing what they say. Most states it doesn't cost much to amend (administration fee+new birth certificate issue). Worst case, they say no and you have to go about doing it the legal name change way-BUT, i would suggest this way first.

will the fact that it has been 22 years matter? Also my middle name is spelled wrong also. On my Bc its Nicole and on my ss card its necole.

Depends on the state. I googled Arizona (not sure if thats where your BC is issued, just took a chance) and they can do them-but you have to do it at the State registrars office instead of your local county.

You just have to have some type of issued item with the way that its supposed to be spelled on it to turn into them to use as evidence.

Yes and no. I have my drivers license, but not in the state that I currently live in. Although I have a lease with an apartment here, purchase cigarettes, and beer, I'm not able to register to vote until I got to the DMV and make the switch.

You might have to pick one or the other to amend. BUT-given that you have 2 different names on 2 different official documents-they most likely will allow you to fix it. Worth a shot to try, at least.
