Who should have custody?

posted 30th Sep
A couple gets married, and has any number of children. After years of this, they grow apart, and divorce fairly amicably. There is no type of abuse (whether physical, emotional, or substance) with either party.

After the divorce, the woman is able to hold down a job and support her kid(s). They don't have everything they want, and there are times when money gets tight and she has to resort to things such as consignment shopping to provide for her family. They are provided for physically, but the mother may not necessarily have enough time to complete attend to them emotionally, although she does love them very much.

The father is remarried and has a very, very nice job. He isn't rich, but he's able to spoil his children slightly and they are very well taken care of. In the event of more children, they each have their own room, as well as a stepmother who is very attentive to them along with the father.

This is an incredibly hypothetical situation. I don't want to hear about custody laws or about what would happen in real life. I want to know, in your opinion, who YOU would deem the better fit for the child(ren), custody laws and children's wishes aside.

EDIT: I guess the point of this post kind of slipped by.

I said who would YOU deem the person with the better environment, custody laws and children's wishes aside.

I don't want to hear joint custody as an answer, because in real life, they most certainly would get joint custody, and they both would deserve it.

I'm gonna have to go with the father. Mostly because we were in that situation, and we DID get custody of our five year old.

Totally clicked the wrong button.

BUT ETA: My response was meant for situations like ours where joint custody isn't possible.

I don't think either should keep them full time. They are being taken care of at both places. They can do it together.

I never understood that. Splitting them up is not good.

They should have joint custody. The mother isn't unfit, so why should he have sole custody?

Guys, in a real life situation, they would definitely get joint custody. I want to know who people would pick to have them full time if that were a possibility.

Ditto. I think they just share 50/50 custody and provide for the child when they are in their care. Nobody shoul have to pay anyone cs.

They are both fit parents so it would be hard to pick just one.

That's too vague then. I don't think the dad should just because he has more money but I don't think he necessarily shouldn't either. As a Mom I'm biased toward the Mom but it would depend on the individual people.
