If BD doesn't use his Visitation?

What usually happens?
I go to court a week from tomorrow and my BD was given 18 hours a WEEK and hasnt even done that in three MONTHS.
My lawyers asking that he have a set schedule in hopes it'll help with consistency.
But will a judge take the visitation away? or what happens?

my nephews dad hasn't used his visitation in the last five years, they wont take it away from him. i think it depends cause also my sister never fought to take it away either.

yeah. I'm pretty much at the point though if hes not gonna be consistent then he shouldnt have it.
its soo sad, he'll show up like once every 3 weeks to a month and my LO will be terrified of him. and then i have to 'force' her to go with him while shes kicking and screaming. :/

Here it's if the father has no contact with the child for a YEAR then his rights get taken away...
My SIL's douche bag ex shows up one day out of the year randomly, uninvited so he can keep his rights to his son... it's so dumb.

Normally t heey don't take the visitation away unless the child is in harms way

They might reduce it but if her is still seeing her they won't take it away. he has to go 6 months to a year with out seeing her for them to take it away.

you can ask for supervised visits. This way, it works him & the child up to a set schedule. If he doesnt complete the supervised visits, then he wont be able to move forward(keeping the child overnight and weekends, etc..). But to answer your question, NO a judge will not take visitation away from the child (unless somehow he is proven to be an unfit parent but even then >>). You would have to hire a lawyer in order to get his parental rights taken away, if that was the way you wanted to go. I just went through all of this in July over my oldest son.

I Do think the father should get the right to see there child. but seriously? its lame. Her father makes little to no effort to see her and when he does, she flat out, to his face says shes afraid of him.
but i guess we'll see what the judge says.. I know the judge I have/had doesnt take much smurf. so hopefully it works out.
