A judge will require evaluations of the older son (occupational and speech). Your pediatrician can give you numbers of places close to you that do they evaluations, and usually they are done at home.
Depending on a diagnosis... meaning if your older son is deemed to have bx issues.. the judge could make an order.... but it would never be to give the father full custody.
I would be more concerned with getting older son evaluated. Early intervention is key with autism. and if you feel he is truly no threat to younger son then your son's father has no basis of a case.

Bobo's mum -- Yes, I am trying to get him enrolled into speech therapy and I'm going through the regional center to see if he needs an evaluation. I know my son is NO threat to my other son so I just really hope he doesn't try to keep going with that and make it a big battle. Thank you.
