Incarcerated Father

Hi everyone,

I need some help/advice about an issue regarding my daughter's father. To start off, here's an overview of what has been going on: from the end of April 2012 - Mid-August 2012 my daughter's father chose not to see or support our daughter. He spent his time and money at strip clubs and on drugs, which led him down a really slippery slope. Then, on August 17th, he was arrested for stabbing his younger brother (assault with a deadly weapon) and resisted arrest. He has a criminal record of possession of a concealed weapon and resisting arrest from about 3 years ago. Since he has been in jail (about a month) he has not contacted me whatso ever. We live in California.
So, my questions are these:
How long will he likely get sentenced to in prison? His brother is not pressing charges.
How can I have the court terminate his parental rights?

I wouldn't expect him to be out until your daughter is well into middle school.

He is going to get a hefty sentence.
In Ohio if the father has not been involved in 1 year you can terminate rights.
DO NOT PUT HIM ON THE BIRTH CERTIFICATE.
DO NOT EVEN MENTION HIS NAME OR THAT YOU KNOW WHO THE FATHER IS.

the state will take over and press the charges my SO's ex dropped the case against him but the state was still trying to press charges the offered him a class and to pay 200 and he would not have to go to court or anything.

The only part of that I can comment on and know I'm 100% sure about, is about his brother pressing charges... The brother doesn't have to press charges since it was assault with a deadly weapon. The state/DA/or even the leo could all file the charges, even if the brother says he doesn't want them filed.
