Paternity test question

So there's this crazy woman who thinks I slept with her son. His wife thinks so too, even though we have NEVER slept together. Can they get a court ordered paternity test done on my daughter, or would the 'father ' have to request it? I really don't want to have to go through all this bullsmurf just to prove my daughter isn't his kid, when he knows we never slept together.

  It's not like I don't know who BD is.

The "father" would have to take it to court.

Does your daughter have a father listed on the birth certificate?
If she does I don't think the state will pursue it, if she doesn't it is entirely possible.

Unless you get BD to take a paternity test so you don't have to go through the court BS.

No, she doesn't. Looks like I might be in for a headache. I know this guy won't agree to a paternity test, though, so I don't know if they would force both of us into it. They're very confused, it dated this man A YEAR before my daughter was even conceived.

Ahh....I don't think they can. Is there someone already listed as her father on the birth certificate? I think there would have to be one done privately first in order to get a court ordered one to change documentation.

When I had my son, my boyfriend signed the birth certificate, but in order to eventually have it changed to his bio fathers name, I had to do a private one and then file for child support, got a court date, presented the paternity test showing that my boyfriend was NOT the father, they gave a vacation of paternity, then they ordered one done on the bio dad.

Can I ask how long all of that took?

There's no father listen on the birth certificate, I don't want to get into it but he was abusive and dangerous, so isn't listed.

Oh, I am in no place to judge, trust me - no worries.

After we had the private paternity test done, I had to go to court and have a vacation of paternity done, which took a couple months to get an actual court date. I then had to go to the Child Support place and file for child support under his bio dads name. It took a few weeks to get the paperwork all entered into the system, I guess, but I got a paper in the mail stating I had a court date to establish paternity in a couple of months after that. We went, I had to have my sons mouth swabbed, and it took two weeks for the results. When the reults came back, we had ANOTHER court date about a month later to settle what he would be paying for child support - which he doesn't ever pay.


Honestly - it will probably take a while, but it's mostly just a waiting game between court dates.

Alright, thank you. This whole thing is just a big mess. He and his wife are getting divorced, and I think she's just reaching for anything she can use against him. I was hoping it would all take a while, if they can ever get a court order for a paternity test. It's going to be a big waste of time, for it to all end up right back where we were with no one listed as the father.

Np! I hope everything gets easier - such a smurffy thing to deal with. She might not even honestly believe he's the dad, I've seen divorce make people do some crazy smurf - it's still not right, though, to drag you into it. At least your daughter is really young still and won't remember it.
