in ohio mom has full custody even if dad is in birth cert unless married so here it would defiantlly be kidnapping...i would check local custody laws sry typing 1 handed

My ex boyfriend went through this with his ex wife while we were together. They went to mediation.. And she wrote what she wanted.. He did the same. They both refused to settle on the others agreement. So they went to court. But he temporarily agreed to hers for some visitation. It was the only way he could see them. But even to get to that. They both had to pay a lawyer retention fee. Without a lawyer. Or at least a mediator.. He had zero rights to the kids.

He haven't been there since the baby was born honestly. So I seriously doubt if him seeing her was an issue. I honestly says he did this out of spite just to hurt my friend since he was being placed on child support.

i asked my lawyer about this because i was worried my BD would try this if i let him take DD unsupervised...he said in this situation you have to file a motion to have the child returned...if you've had the baby the whole time the judge will order him to return the child to you...then once you have an order the police will help get the baby returned...after that you have grounds for requesting supervised visitation.

But he's name is on the birth certificate. Will the motion still work under those terms??

yes my BD was on DD's birth certificate...the police won't help until you get a court order for him to return the child.. you can file a motion demanding the child be returned...my lawyer said the judge will make him return the child in a case like this where the mother has been caring for the child the entire time and has been giving visits in good faith..it will look very badly on him once the child is returned.

Thanks I will also mention this to her. Do you have to have a lawyer first before you file the motion.

You shouldn't need a lawyer, or at least we didn't when we filed.

I don't think so...here you can pay 25 for the court facilitator to help you fill out the papers. not sure if you have court facilitators down there
