child support/visitation question

ok my sons father has a 12yr old whom he pays child support of the amount of $270, he pays me child support for my son which is 3 in the amount of $205 cuz of retroactive, but once he pays his dues it will go down to $170...1st i think its unfair that they are both unequal, either they make mine higher or lower his, i already asked for the modifications papers to ask for a raise, do you guys think its only fair they both get the samme amount?

also i was told that if i get court ordered visitation they will automatically lower his child support is that true?

the first child always gets the most per month. and it won't get changed - it's not fair to the first child to get less because the father decided to have more children. it sucks, i know....but i understand it.

I'm not sure about the second part but the oldest kid generally always gets the most.

Your support takes into consideration the money you make normally. If you make more than her, you will get less support.

I think they work it out by the child's age and the level of care that would be required for that age, Your child's may go up as he gets older, Also maybe he has arrears to the first child, Which is why it's more than your getting?

I receive child support for my youngest two from their dad, But he also has a child from a previous rel, And Pays more for that child due to the amount of arrears, She (Other baby Mum) gets her debt cleared before my kids do ... Just the way it works.

They normally don't lower support over visitation. You can try to have it modified, but it goes by both yours and his income

i understand its not fair to his 1st son, i just think they should make them equal, he makes the same amount or maybe even a little bit more and he helps his other sons mom with everything she needs and buys his other son everyhing he asks for besides the child support money, and i dont get any help at all from him

The support may depend on the other mother's income also. SHe may have a lower income or no income. And visitation has nothing to do with the amount (at least not in Ohio). As a matter of fact when my DH took the mother of his kid back to court for shared parenting, they tried to raise his child support because of my income. His lawyer fought it because my income has nothing to do with it.

at that time she was working and i was a full time student and just graduated about a week ago from school

My BD does not work. And I only get $698.00 a month in ssi. At this moment he us trying to modify as well to have my support lowered. I wonder if they will do it, and how much it will come down. I'm supposed to vet $400.00 a month from him.

yeah....i understand how that could be pretty unfair. my oldest son's father has a son from a previous relationship that he visits and has a relationship with. however, he has only seen my son twice (last time was over 3 years ago and my son is 4 now)...so my husband ended up adopting him. hopefully your ex will decide to help your child like he helps his other child.

In my state if the father doesnt work the mom gets $50 a month

i live in colorado though, its very few states with laws like that
