Non-custodial Ins question.

My stepson has been on medicaid since he was born ( he is 6). We have offered and asked to put him on our case. His mother said no. Now she is saying we are going to have to pay medicaid back.
She does not qualify anymore but we do so we are putting him on ours.
Any idea on what might happen?

Thats how it is supposed to be, but up until now my steps sons mom didnt want to take him off her medicaid case.

DH is not capable.

Then insurance will stay through the state with the custodial parent.

LO can be on medicaid and secondary health insurance. As far as I know, both parents do not have to agree to it to put the baby on health insurance.

Medicaid doesn't have any stipulations that the noncustodial parent is responsible as far as I'm aware. And it depends on the parenting plan. Mine says that her dad is responsible for her medical care. If theirs doesn't say anything like that then it would be her responsibility.

I just noticed you're in Texas. When I was in Texas, I had medicaid for my daughter. They didn't tell me anything about having to have a secondary health insurance for LO or if her dad has health insurance that she needed to be on it. She was on Tricare and medicaid for a while. They billed Tricare first, then medicaid. Once she was taken off Tricare, they never required her to have a secondary health insurance. Hope that makes sense.
