Using homosexuality as job security

So here is the situation...
My job has a very strict attendance policy. You are required to be there 97% of the time in a rolling calendar year. Once you drop below 97% you get a verbal warning. If you miss another day after that, you are given a written warning. Another day after that you are put on termination notice after having a sit down with the manager. Another day and you are gone. No talking, no arguing, just here is a box to gather your things, we will walk you out.
This guy that started the same day as I did dropped below 97% in March. He was given the verbal. He missed three more days and received the written. Since then he has called out of work ELEVEN more days. He still has a job! I asked him how was he not out of a job and his response was "They can't fire me. I am in a protected group.". Well he is gay and I would assume that is what he is talking about.
Is this possible? Do you agree with this? I am just appalled at the situation because he should not be receiving special treatment based on his sexual orientation.

I hate when people use that crap. I mean really...who the hell you choose to bang in your free time should have NOTHING. To do with your job. Ugh

I dont know your laws down there, but yeah, here, we have laws in place for people to not be discriminated against....but your company wouldnt be discriminating when hes missed this much work.
Dont let him get to you, theres more to the story that you probably dont know and hes trying to razz you.

If thats the case then the people at your work are really smurfing stupid. If that is their policy, and it shows that he has been given the warnings then they can legally fire him whether he is gay or not. If he tries to sue, I'm sure the courts would laugh in his face because it would clearly show that he was given his warnings and went against their attendance policy.

It just bugs the smurf out of me that he still has a damn job. He is so annoying about it to and just calls out sick and then posts pictures on FB of his day at the beach. It is ridiculous.
I mean I didn't get my last raise because I am on attendance warning for missing a week of work when I had meningitis. And this lying jerk still has a damn job!

I dont know how the "protective group" thing works, but Im sure your company would be able to find a competent hard working gay person to take his place if they need to meet some kind of quota.

No one should be exempt from the rules due to their sexual orientation. If someone has cancer and still manages to work some days I think they should be protected from being fired and severe illnesses such as meningitis as OP had. Being gay does not affect a persons ability to work.

I am in remission from cancer and have constant pain from it...and I had meningitis. I should be doubly excused!!
I honestly can't figure out what is going on, but he missed work again today!
