If it's in texas, like where you said you are then yes he can be charged with statutory rape. The age of consent in Texas is 17, she's 2 years away from it.

I doubt it. That's only 2 years difference and they're both under 18. Also even when he turns 18 there isn't big enough of an age difference.

No, it's not very likely.
Here in Ohio, an 18 year old can legally have sex with someone 3 years younger.
(Unless rape of course)
A lot of states changed the law due to people abusing the age limits, so since they are both minors it's not likely.

If they are close in age, no. They are only 2 years apart and under 18 so it's ok anything 4 years older and under 18 than yes. Well, where I live I believe that's what it is.

It also has to do with how the parents feel about it, if the parents truely want to charge him then they can. I've been there! My mom went after my BF when I was a teenager because she got pissed off about something, even though she knew we were together and were having sex for several months. She asked for the charge and the courts went after him.

Honestly, it all depends on the state laws.
My brother is 18, his girlfriend is 17.
He is going to be 19 in a month.. and she will still be 17 years old for 3 months after.
Her parents already tried to file charges, but they wouldn't hold up in court due to age guildlines and the girlfriend said she wanted everything to do with him.
Unless the girl herself claims it's unwanted relations. (no matter what they are) it all depends on the state laws.

SO turned 17 before I turned 16. He is now 18 and I dont turn 17 untill next month. My bestfreind is 17 and dating a 15 year old. They are exactly two years apart. His mom is always threatening to call the cops on her though. *shrugs*
