Move then tell him because divorce and custody are two aeperate issues he can file for custody before ur divorced. Then after thirty days file for custody in new place as then he will have to come to ur area for court ect

If he files for custody in his state, her state wont allow for her to file for divorce. I'm currently going through the same thing. My ex couldn't file because I already had a child support case open in my state.

That's a very tough situation to be in. I get you wanting to go home where you have family & support but I wouldn't wanna take my son away from his Father.

That's what i was saying in the op. Ill do everything i have to so that he can continue to see him as much as he does already.
