Grandparents and their rights?

posted 4th Aug '12
I live with my dad, and BD has been causing A LOT of issues lately. Tomorrow I have to go to work and my dad was going to watch LO for me.
BD says he's going to come and take her.
If LO is at her home with her grandfather, does BD have rights to just take her away?
We have no custody agreements as of right now, I'm working on it, but it hasn't gone through yet.
I'm scared to even go to work because I don't want BD showing up and taking off with her...
What rights does my dad have as a grandparent? any at all?

They have a right not to answer the door to them.

Your dad has no rights.. But he can get him for trespassing. He's not allowed in your dad's yard without his permission.

Tell him not to answer the door. Is your bd on the birth certificate?

Yeah, he's on the birth certificate.
I think I'll just talk to my dad and make sure he knows just to lock all the doors and don't answer.

Not being on the birth certificate does not mean that BD has no rights, this is a misconception that is sort of pushed along but not always standing. ( I know from experience.) And to avoid more issues you need to talk with someone and get a game plan together. Have you find for emergency custody? It may be time to talk to a lawyer or a woman s shelter in your area to find out your options. Because honestly things will just escalate with the drama in the future. As for your dad, there are no laws that say a person must answer their door, or phone, or anything, unless there is a order to due so. Your pops should just let him knock, tell him without opening the door to leave and if he doesn't call the cops and have him removed. Best of luck.
