If you have joint custody, you need his permission before you move especially if his visitation is completely interrupted as it would be with you moving so far away.

Why should he lose out on time with his child because YOU want to move away?

Well I'm not sure but I don't think it's fair to cut his time when you made the choice to move. You could even get in trouble for it if you had a legal arrangement in place through the court and didn't take it in to be revised and approved before moving. You should probably go to court and have it settled there.

He originally was okay with the move. Besides the point, Im asking if it's in her best interest to be with mom majority of the week or go with dad majority of the week when she clearly hates him for some reason (I have asked and she wont explain)

Do you have it in writing? Or as part of a court ordered amendment? Maybe he felt pressured to agree to it?

Regardless, if he says no...then the child can't move unless you take it back to court.

yes, it's in writing. we are civil and he has been supportive and understanding in regards to the fact i was unable to find a decent paying job in his city

Ok, one if he was ok with the move (must have in writing for court) and you moved due to job, courts won't hold it against you as long as you notified him in advance in writing, most places is 30 days in advance. At least that's how it is for my ex and I then again he's military.

As for your daughter, I can't remember what exactly it is called however basically it's a representative for her in court. They will discuss things with her separately (sort of like a therapist) and then you and her father will appear in court and the representative will appear for her. Not sure if she's of age to say what she wants in court. Varies from place to place. I think it's the best way to go about it.

continuing joint custody (he was going to get her every friday-sunday evening) i dont think the letter will have much weight legally...my main concern is my daughter feeling abandoned by me or passed over while her baby sis is with me full time...

So, then you need to take it back to court.

She won't feel abandoned or passed over for her sister as long as you don't project that feeling on her.

Also, you better hope that letter DOES have legal weight because if not, you just broke your court order and you could be found in contempt.

Notarized how? As in him signing the letter that he agreed to the move and a Notary signing off that it was him signing it and that he understood what it meant? What county are you in in Texas?
