Step -Parent Adoptions

Has anyone gone through this process,or know how it works in the case of the child not having a father listed on his/her birth certificate?

if you know who the father is then he has to give up his parental rights. If you don't know then I'm not sure how it works.

sounds like if dad was never in the picture or on the birth certificate then there should be no prob. but I would google it if I were u...

I'm pretty sure I'm right about this. My dad is a lawyer & I've worked in the legal field for almost 10 years. I think if you don't know who the Dad was you have to do a publication in the paper in the legal notices notifying a potential father of your name and the babies DOB (so they would know approx. 9-10 mos before if they had sex with you) that a child was the result.

I'm virtually certain on this & I know it sounds ridiculous. I live in Oklahoma (so I'm sure all states will be different on this) ~ I worked at the courthouse for 5 yrs and dealt with alot of paternity & adoptioncases and have actually seen the publications that women had to post to notify guys of the baby so it could be adopted.

Yep! "Punitive Search for Father". Once thats done its pretty much easy sailing. You might be able to get the papers online for it. I know you can in Floridabut I dont know about Minnesota courts. If they have a online self help for court houses there then you would find them under civil or family law.

Hmm...well she lives in MN,but the child was born and conceived somewhere else-I don't know where.Would she have to file for it here to in the state of conception?

I know. I personally would be mortified to post that in the paper, but hey, ya gottado what you gotta do for your baby! No one really reads the legal notices anyways...

I could look up more info on it but I'm sure it's slightly different in different states, so it wouldnt' do much good for me to look up how exactly to do it in Oklahoma =)

But good luck though. I would make an appt w/an atty for just their advice/legal opinionand then decide what I wanted to do. Maybe they'll do a free consulation!

She'd have to file it in the county or town of the fathers last known whereabouts

Right on-I'll pass that along-what's really humorous is that I have kind of a love/hate relationship with this girl,so I might get a small amount of pleasure from her having to put her name in the paper-lol!

State of Birth and county or town of the last known residence or possible the county of birth but I'm not sure but like I said it depends on the state laws. It will usually tell you on the Puitive Search form what all the requirements are. Some states may require more then just the paper ad like looking into town history records for a last known address. Its all outlined in the forms she gets to fill out.

See,if I had known the legal notices were chock full of juicy information like that,I would have been reading them a long time ago!I feel like I've been missing out!

they normally aren't too interesting. But alot of the time you find out people are getting evicted or judgments for not paying their credit cards. or divorces.

You'll have to start reading them!
