breast feeding and custody

posted 22nd Jul '12
I feel like I sound like a broken record...but just to get a better idea of how this usually works, how often do women succeed when the the father of their child wants visitation but she is working/going to school and nursing and can only produce enough for the baby when she is away at work or at class...what are your predictions on how this kind of thing will pan out?

Depends on the age of the child. But they are not going to keep the child away from the other parent because the mother chooses to breast feed.

unless the other parent is proven unfit, they will have visitation.

They will probably either tell you that you can provide him with milk for the child or that the child will be formula fed while visiting with the father. You can try an get visitation for a few hours a day while you are at work or whatever but their first priority is making sure the child gets visitation with both parents.

Dang I should have framed this differently...I MEANT to specify this to OVERNIGHTS...how will they handle it with overnights....meaning like, will they not award overnights since it will be impossible for me to sustain breast feeding given that I am already under enough pressure producing for while I am at work and or class (I will only be in class one night a week).

It should be taken into consideration. I'd read the articles on the LLL website about breastfeeding and family law.

http://www.llli.org/law/lawus.html

And in particular this article.

Good luck!

same probably goes for over nights...either you produce the milk, or the baby will be formula fed with the father.

honestly, I don't think the court is going to be concerned with your supply.

You can ASK for no overnights to avoid the situation but whether or not they award it to you is a different matter. If the father is adamant enough about having the baby overnight they will tell you that if you don't provide breastmilk the child will be formula fed.

Then I don't understand why the law is framed to protect breast feeding mothers and anything that gets in the way of producing enough milk and sustaining breaat feeding...

the American Ass. for Pediatrics or whatever it is called recommends doing it for two years and if I dry up bc of these overnights (yes I can pump...but my breasts don't do great with the pump to be honest), then the system would have gotten in the way...Idunno...I'm just curious

It's not the fathers or the courts problem that you go to school tho. I think this is a tough titties moment.

Your welcome.   I'd research more online but I think these are some of the best articles with accurate information. They should be a good starting point. If he's reasonable maybe you two can work it out and then just have a judge okay it. Knowing what the laws are is always good and will let you know what you can reasonably ask for and what has been supported and done in the past though, which is useful. I hope it works out well for you.
