take ME to court?!?

my BD tells me today he wants to take ME back to court for MORE visitation!

When we went the first time I was the filer. And he was awarded supervised visitation wednesday 4-7 and sunday 12-3. And any other days we agree on including holidays! AND HE WANTS MORE!!? I have been allowing her to see her WAY more than just those days already!

Do you think he will be awarded more time.

Just some background to our case: He has DV charge and a FPO that I had filed. DD was present and 3 weeks old at the incident of the DV. And he is a recovering heroin addict and pill head. Also recovering alchololic. And he has 3 felony charges pending.

Good for him for stepping it up to be a good daddy. (I'm assuming)

Even if you were letting him see her more, maybe he just wants to protect himself legally

It's already in the papers that he can have exra das if we agree.

maybe he's just making sure he has more time with her, bc by what it says now you have to agree to it, he wants specific times in writing, i don't see anything wrong with that

I think having the court add more days (officially) for him (not just verbally between you two) is a good thing for him.

If you've agreed to him having extra days, then yes...he has a very good shot at it.

Sounds like he wants to ensure that he can have visitation without you having to agree to it.

He can motion to change the visitation order. It's in his legal rights. It won't be a new court case. It will be a continuation of the old one. You can also request that he have a drug test and seek counseling for his past incidents.

It scares me. He still cannot take care of her the way she needs to be. Everytime he has visitation he plays on his phone most of the time. And its not guareenteed he is off of drugs. He has showed up for visitation under the influence. A few weeks ago he took a bunch of mucsle relaxers and could not walk. His entire body was twitching. He was in no position to take care of a child.

So, why do you give him extra visitation?

Agreed. And I don't see the problem with more days... as the kids get older, visitation (at least in KY) was every Wednesday night and ALL of every other weekend. So Friday, Saturday, brought back Sunday by I think 6. I think a few more hours on the days he has, or a whole new day is completely understandable.

I tried that. The judge just said he wasn't concerned with hearing about his issues -_-

well i'd make sure you have that documented, and maybe you can get it put in there that he has to get regular drug tests?

He still has legal rights to change visitation.
