sole custody??

So I know its different for each situation but how does one go about getting sole custody? Would you only be able to get it if the other parent was proved to be unfit? Do they automatically give joint custody for both parents when you go to court? Can you fight to get sole custody even if the other parent wants joint? TIA

Go file for custody and file it as sole.most states give mom sole physical with joint legal

Umm yea you will most likely have joint custody. Unless you can prove him unfit or some other circumstances. I got primary, but only because my ex smurfed up and it was used against him during the trial. The judge had no choice but to award me primary. We have joint custody with me primary physical custody.

So what is primary custody? Maybe thats what Im looking for. I want him to get visitation but thats it.

You want to be the custodial parent... Which the child resides with. He will be the non custodial parent with visitation.

He gets him every Thursday and every other weekend. With summer break we rotate every week.

Even if you get full custody, he can get the right to have his child atleast every other weekend unless its proven that he is so bad that he only diserves visitation rights to where you or someone is there to watch him

This would be ideal honestly.

No... Its not. Especially if u go into the court saying u want him to have visitation... It should all go pretty easy since u guys arent fighting. They will set up child support seperatly though. But he will pay cs to u since u are the custodial parent.

Yea during the summer. Otherwise every Thursday overnight and ever other weekend overnights.

The judge isn't just gonna award it to her because she wants it. Especially if he doesn't agree to the terms. Then they will have to go to mediation. When that doesn't work they will have to go through a trial process in which she has to prove him unfit.

Do you know if there is a site or anything that has examples of an unfit parent? Like more besides the typical drug addict, abusive person, mentally unfit ect. Or are those the only things that show an unfit parent if you get what I mean?
