They would need a paternity test and I believe he will more than likely have to pay back CS.

Yes and probably not. Usually, you only get cs from the time you first apply until they starts paying it. So if you file in 2012 but don't get it all sorted until 2012, you may owe back payments for that time frame but that's it.

Every state is different. A lot of states it's back cs from the day it's filed

they will do a DNA test first, then they will start child support
my daughter is 3.5 and hes STILL not on her Birth certificate and he still pays child support. its up to him to go put himself on it. HOWEVER, if i did not have a case against him i could have put anyone on her certificate (ex. my husband now)

yeah mine did it from the day we did a paternity test..because i agreed to it then, otherwise it would have been from day 1

we did the test on our own, then i filed for child support a few months after.

It's for sure his kid. He was 17 and she was 15 when she had him and her parents did not want her to put him on the birth cert.

it just varies. it depends how she/he fights on the dates

No. Back child support only dates back to the day she filed... not when the child was born. But yes she can file & get CS if he's proven the father through DNA. People make such a big fuss over the BC when really it's not THAT important.
& If he is proven the father, his name will most likely be put on the BC.

That's not true. Otherwise I could file for CS when my kid is 17yrs old & get 17yrs of back support?? I don't think so.

No. Not always all states are different. Here it is from birth unless the residential parent only wants it from the application date.
