They will order a paternity test. When my ex-husband left I didn't file right away. They only ordered child support from when I filed. He even got away with something like $25 or $50 per month for the back support and then the rest was at the regular amount. I live in NY though. I also have an ex who always has a sad story on hand and we always have the same judge who always listens to it.

But what's the cut off for that? Like, have to file CS within a certain amount of time? So somebody in your state can file for CS when the child is 17 & get all those years back pay??

Yes she can but the courts are going to want a DNA test. And yes he will have to pay back support... I don't see why he wouldn't want to support his child...

Yes it can. happened to my brothers dad... He was only 13 though.

At that point it would really just go to the child and not the mother. Or at least you would think... after the kid is 18 they get any back money I believe.

Yeah, you would think he would. Although, you would think he would also want to SEE his child, but he never does. At least our SIL see's him as much as she can.

  That's crazy. Was it like a big lump sum she got? Or did he still make monthly payments on the back support?

So how long do parents have to pay child support for? Until they're 18? That's what I always assumed... but I was watching the peoples court yesterday   & there was this dad suing for child support he paid when his daughter was 20 & already living on her own.... he ended up winning the case.

Scott's only goes back to the day she filed. She tried to do it so he would have to pay back cs for almost a year but it only went to the day she filed.

He may not have to pay her back child support but the state did bill my brother for care they had provided up until the point that his ex filed for child support. He had to pay back a portion of his medicaid costs or something like that.

absolutely.

All she has to do is get a DNA test proving that he is the father. Then prove that he has not been in the childs life & that she has been fully support the baby.

NOW ... if he didn't know about the child, or has some what of a reason fro not being in the childs life he could get SOME money cut off. But if he knew the child was his then he is going to have to pay it all back.

For example: My mother took my biological father to court for child support and custody when i was only about 2. My 'dad' had to give 10,000 for back payments. (this was in 1990)

He wouldn't pay it so they arrested him..... Like he wouldn't pay AT ALL after the judgement... I believe they waited for him to even make a payment but nope.... he ended up having to pay 10K to get out of jail.
