Surrogacy..

After watching 'rules of engagement' I decided to look up surrogacy and I came across a part which I thought worth dicussing.
"There have been cases of clashes between surrogate mothers and the genetic parents; when unexpected complications with the fetus makes the genetic parents ask for an abortion even though the surrogate mother is opposing the abortion.[5][6]"
What are your feelings on this?

This is one of many reasons why I personally couldn't be a surrogate. I give women who do all the credit in the world because it's a very wonderful thing to do for someone. But at the same time, it could get complicated and bring up some big issues. I suppose it depends on how you go about it too. I think it's probably best if all scenarios are discussed beforehand and if possible having it all in writing. Things such as what to do if complications arise, they would need to discuss many different possibilities and what if anything to do in each scenario.

Wow , that's a tough situation. Myself , if I were to be a surrogate mother , I would not want to have the abortion being pro-life. But the baby is not genetically mine , so I would abide by the genetic parents wishes , even though it'd be extremely hard on me. But that is if I were in that situation. I can't speak on someone else's behalf. Great debate question though.

This is exactly what I was thinking.
Obviously there are different types of surrogacy, if the surrogate mother was too the biological mother, do they still have the right to ask for an abortion?

If i was ever a surrogate and the parents wanted me to abort, i would just try and adopt the baby instead, and ask them to sign the baby over to me. i don't ever want to put my body through an abortion. ever. Thats my choice and i don't feel like they should be able to make that decision for me. I understand that it is their child, so I would probably have it in writing somewhere before we even get started that if by some reason or another they want to terminate, i would parental rights instead.

Well, while it may be her body, it's not her "baby". This is why you need to have something in the contract that covers abortion.

Yeah idk. They would definately need to discuss all of that before starting the surrogacy. That would be a really hard situation to be in.

Of course I agree, but what if there was a problem with the couple that wished to have a child and had to, say, use the artificial insemination? Who's right would it be then? Because of course, the surrogate mother would also be the biological mother?
It is a tough question, but written contracts would deffinately have to be dicussed..

I know there is a case of a woman who petitioned to keep the child she half concieved and was then going to give to this couple. They ruled that it was in the best interests of the child that it was not separated from the mother, if things can get to that point, I cannot imagine for the life of me that if you have half your DNA in a child that you could be forced to abort, especially in special cases of surrogacy you didn't even have to give the baby up. Just a thought

Ok well first there's a difference between being a surrogate and a gestational carrier. I'm actually not a traditional surrogate which is where the carrier is using her own egg. I'm being a gestational carrier where the dads sperm and an egg donor was used. When I applied to be a gestational carrier, there was something in the application that asked me if I would be okay with having an abortion upon the parents request due to any reason such as birth defects and all that. I said that I would be because it's not my baby and not my choice IMO. Luckily I got set up with a couple that told me they wouldn't have one just for birth defects or downs or anything. At the beginning, after you agree on everything with the parents and before the embryo transfer or whatever is done you enter a legal contract that you must follow. That being said, surrogacy is a very gray area in the law in many states. My legal contract specifically states that couple needs to understand that if I were to take it to court to keep the babies the courts could choose to disregard the legal agreement and make any choice they want. This has happened before which is why in some states traditional surrogacy is not legal.

I'm pretty sure it's standard for this to be a part of surrogacy contracts. If you as an IP knew you would want a baby with genetic defects to be aborted, you wouldn't go with a surrogate who would be opposed to that. So it really shouldn't be an issue should that happen.
