I wouldn't sue for that

He will be fine, no lasting damage

if you didn't have insurance or something, then I would expect target to pay the medical bills

but that's it

It was pretty much your sons fault for climbing up the pole.

I'm sure you might win if you hire lawyers but then you have to pay them and use your time.

if you did, you'd probably loose the case. They'd say it was your sons fault even though the outlet was sticking out.

This is what I told my husband. I just wouldn't feel comfortable trying to fault Target when I know this was all my son's doing.

Did you make a report with the store before you left? Unless you did inform SOMEONE there of what was going on, they are not responsible once you leave the store. I was a store mgr for a big retail store and had to take care of this kind of stuff

No. You said it yourself, your son shouldn't have been climbing the pole, and as his mother, it was your responsibility to watch him. Target is a store, it's not meant to be kid-proof. They assume that people aren't going to be climbing their poles, and that parents will make sure their children behave. Instead of asking him to come down, why didn't you physically help him down?

No, I'm sorry, that wound looks painful, but this wasn't Target's fault.

No, it's your sons fault. If you didn't have insurance then yeah i'd have them pay the bill but since that's not the case just leave it alone.
