Why would Target have to pay for the medical bills? It's not their fault he wasn't being watched and was climbing a random pole.

It's not like they had stakes sticking up from the ground.. they had an electrical box on a pole.. I'm sure they didn't foresee someone climbing up the pole when they put the outlet there...

Two feet isn't very high at all for a kid that climbs. My son can be two feet up in a pole in seconds.

And all kids have that kind of common sense at age 7

I guess it would be different if he was 3 or 4?

I have a climber too, but he knows not to climb on smurf that's not meant for climbing.

and if your kid fell from something he wasn't supposed to be climbing it would be your fault / his fault. not the store / owner of the poles fault.

Everywhere I have worked, you have to report within 24 hours. But, fwiw, I wouldn't sue them either.

If his mother knows he wanders off and is a climber, she should have the common sense to keep him by her side and keep a better eye on him. & yeah, 7 years old is old enough to understand that you don't climb on things that arent meant to be climbed on. Smurf, my kids 3 and he knows that if it's not MADE for you to climb on it, you don't climb on it.

Quoting Lovelyyy*:" had he not been climbing the pole it wouldn't have mattered that the sharp edges were there, she should ... [snip!] ... shouldn't have to pay the medical bills of something that wouldn't have happened had she been keeping a better eye on her kid."

To be clear, I didn't say she should sue.

But for argument's sake, the outlet was close to the ground. Would they be liable for the bill if he'd gotten scratched walking by it? If he was only 2 feet off the ground, and assuming at age 7 he is taller than 2 feet, then its logical to assume anyone could have beet cut on it by walking too close to the pole. Climbing wasn't necessarily the issue

He's got ADD, so maybe he doesn't think "Is this for climbing?" before he acts

If someone's close enough to a pole to get that kind of cut just by walking by it, they probably aren't paying very close attention to their surroundings. You would have to actually run into the pole to be cut by it, in which case, it's still your own fault.

adhd doesnt inhibit your ability to know if something is made to climb on or not. AND as his mother, for the 546857231687th time, she knows he has adhd and wanders off so she should have had a better eye on him.

It actually was, if he wouldn't of been climbing he would of never of gotten hurt. If someone was to get cut because of walking to close to the pole they obviously weren't paying attention to their surroundings to begin with so it'd still be their fault.

I think we're missing a lot of information.

Where was this pole placed? In the middle of the store, or in a corner somewhere?
Did he really only climb up two feet?
What was the approximate height of the outlet?
How long was he unsupervised?
