knowing your son wanders off, its your responsibility to watch him. if he had enough time to climb 2 feet or so off the ground, clearly he wasnt being watched for a decent length of time. lol. you or your husband, whomever suggested sueing target is retarded.

You would have a case if he was just walking and fell because of something in the way or something to that effect but, in this case you don't.

Um, no. You don't sue people for things that are your own fault. You shouldn't have let your kid wonder off and that never would've happened.

I would not persue legal action. As you said, it was your sons fault, he shouldnt have been climbing on a random poll thing. Although i would also agree that the maintenence issue could have easily been corrected by target before this incident happened. However, who is to say even if the outlet has been on all the way that he still would or would not ha e ended up with the gash just by climbing the poll. Not trying to sound like a bitch at all, as a parent i would be upset and im very glad your son wasnt injured any worse, but target was not intended to be a playground. I understand ur son has adhd but stilll....

My first step would be having a meeting with the manager and asking for them to pay the bill. I think they should be responsible for that much. Yeah, your son was climbing a pole. But hell, they shouldn't have sharp edges in the middle of the store.

First off OWWW and I dont think so - you said it was your sons fault - and I am sure they would use the video surveillance footage as proof- and then you could end up having to pay for their lawyers - not sure how that works

No grounds for a lawsuit. Its your/his fault he was climbing up the pole with a visible hazard.

had he not been climbing the pole it wouldn't have mattered that the sharp edges were there, she should be thankful he only has a cut leg and not a busted head. It could've been much worse. Calling and asking them to cover it should suffice, they shouldn't have to pay the medical bills of something that wouldn't have happened had she been keeping a better eye on her kid.

the poles arent for dancing and swinging on. it's common sense that you dont climb on smurf thats not meant to be climbed on.
