getting Child Support from incarcerated father

CSRU said they can take up to 50% of any income he makes while in prison... perhaps im misinformed but while locked up dont they barely make anything, like less than a dollar an hour??

They also said that the child support would build up if he doesnt make anything... and he has to pay it when he gets out... but hes facing 20 years. My son will be grown by then... so what happens then?

Prisoners don't earn much at all, so you really shouldn't expect anything.

And once he's out in 20 years, he will still owe you.

He'll most likely end up owing you money for the rest of his life and you'll get a tiny check from his license-plate making or whatever his "job" is...

I'd probably just cut ties completely and lose the headache...

When my ex was locked up my lawyer told me I could get cash aid for the baby and they would open child support case against him it will just rack up... if/when he gets out he has to pay it back...

I just gave up wasn't worth all the headache for me but if u need the money I would look into that...

I have a restraining order against him. I couldnt give two smurfs about him. the state is MAKING me cooperate with CSRU.

Well then I guess just collect your $10 checks and call it a day... my only concern would be that if he's paying CS, technically he has rights to the child... but if he's going to be in for 20 years, by then your child will be old enough to decide on his own if he wants to meet daddy dearest... so I wouldn't really worry about that either.

That's not always true. I receive child support from my daughter's father and he doesn't have "rights" to her. He never petitioned the court so he never got any. Child support isn't an admission ticket to your kid.

Well, right... cuz your ex never petitioned the court so you got lucky. But if this guy wanted to, he could get visitation (if he wasn't incarcerated, obviously). Parents that pay child support have the right to visitation. Since he is in prison and is going to be there for a long while, I guess I'd take what I could get and not worry about it.

Child support and visitation are unrelated in the courts eyes. People who don't pay support CAN still get visitation and People who DO pay support don't always get visitation.

Out here in Cali if the Childs father goes to jail/prison the payments get dropped down to 0.00 and resume when he gets out and starts working......
