Leaving state with divorce/cps

My husband and I agreed that I come down and we mutually file divorce, do it the right way together, so that we're both on our feet at the end of it. On the way down here, he called CPS claimed I was a prostitute, homicidal, suicidal and on drugs. All un true. He filed a police report stating I was going to killh im. Not true. He's not making my life a living hell. I have no support here. I want to go the smurf home. Now. And handle my smurf there, where I can make money, and make ends meet easier with support of friends.
Can I legally do this? I'm going to speak to a lawyer at one. How can I get the car? Advice? I have no money or chance to make money here to fight back with a lawyer. Jag and free income lawyers are not an option now.

if you have a pending case I wouldn't leave the state because they can demand you return or hold you in contempt. especially if you have a pending custody case open with your child. you may want to call a lawyer and see if it is possible. so you don't get in any trouble for leaving
