No, I don't think he should be charged. All he did was what ANY parent would do. And that's protect his daughter. He just flipped out because his child was being hurt. He's not to blame. The man who hurt his daughter is the only one to blame.

texas law says he was in the right in the manner he defended his daughter...so he did nothing illegal and there are no different laws for certain people

The law says you can use deadly force in this case (since it says he was raping her). The little girl wasn't able to protect herself, the father did it for her.

Well, per Texas state law, what he did was 100% legal and not a crime. According to this article it is legal to use deadly force while defending oneself or their family from a sexual predator. Based on this he should not have been charged with anything because he did not commit a crime. They investigated him thoroughly and found several witnesses who could corroborate his story. Not only this but there was physical evidence of the rape.

So no, I don't think he should've been charged.

Anyway, I would hope my husband would do the same thing for our son. I wouldn't want anyone to die as a result but if someone was killed while attacking my child I wouldn't exactly feel as if it was wrong.

Yes. I believe that if you kill someone you should go to jail for it.

Then I disagree with Texas law. Wouldn't be the first time. Murder is murder for me, regardless of how it happened.

I didn't see her say that, I just say her say she thought that if you kill someone you go to jail even if it was accidental.

the guy was raping his daughter. he jumped on and beat the guy to death. he didnt intend for the man to die, according to my understanding, but he killed him defending his daughter. not murder, imo.

That has absolutely nothing to do with what I said. You asked her if she didn't think one has the right to defend themselves and I responded that I didn't see her say that in any of her responses. I'm well aware of the story and stated my opinion on it back on page one. Just because this girl thinks he should serve jail time for killing someone doesn't mean that she doesn't think people have a right to defend themselves. And she has a point, people serve time for things they didn't mean to do all the time.

EVEN if it was accidental, regardless of the circumstances. I never said I don't think the man shouldn't have protected/defended his daughter, I'm saying that someone died, and the person that caused it should be given jail time

i think the fact that the guy died is sad, but if he died b/c the other guy was defending his daughter from rape, then too bad. if you believe in self defense then you believe in self defense. if im defending myself or my child and the person trying to hurt us dies, so be it. causing someone to die doesnt make one worthy of jail. causing someone to die without just cause makes you worthy of jail. protecting a daughter from rape? just cause.
