Yeah I'd say he has a snowball's chance in the south of hades for that to happen. He sounds 'special'.  

By special, I mean pretty stupid.  

If you can prove he is using and dealing slim to none for him. He may get supervised visitation.

Keep notes of smurf he does ates and times he sees him. Info I know on him. Chances are slim request supervised visitation

sounds like the chances are very slim for him to get custody let alone unsupervised visits. i would get an attorney and file custody papers asap! beat him to the punch. if you have family and friends who know how he is with your son get them to write up a NOTARIZED letter (has to be notarized to be a legal document) stating what they know about him how he acts in general and with your son and anything other stuff they have noticed about him and you can turn those as evidence to the judge. if you have any text messages, voice mails, facebook messages, comments anything that shows he wants to do harm to you or your son those wil lstand up in court.

Yeah, he's not going to get full custody of your child   HOWEVER there's a good chance that, unless you can back up your claims that he's unfit, that he will get some sort of visitation and legal custody (ie. he has equal decision making rights if not physical partial custody). And, btw, him being on probation is not a good reason for him not to be able to see your son. You CAN however ask that he is drug tested and has supervised visits. For now, don't allow him to be alone with your child, ever, until there's a binding custody agreement.
