Legal help (LONG)

Long story short

Last year January 2011 me & bd went to court to establish patenting plan. At that time we agreeded to send our lo to his mothers house for child care costing each parent $100. Between February and January 2012 there were numerous problems with our lo behavior she was basically emotional crying throwing fits every single day, as she turned 4 in October 2011 I spoke to him and mentioned that I think we need to look in to preschool, even if it's only part-time he didn't want to hear it. I again revisited the issue and told him she is 4 and I believe a structured environment with other children she could interact with would benefit and help her.

He shot down the idea every time stating she doesn't need anything and it will cost too much money! In January 2012 I told him that I was just going to go ahead with placing her in one without his help since he's basically being ignorant. I found a place enrolled her spoke to him and told him where it was at and what days she would be going. 3 days and Thursday's she is with him court ordered visit day and she could be with gma fridays.

He told me that they (him and his mom) wouldn't help if the center closes like on holidays I said ok?? Had to finally bump her up to a full-time spot in march because I had taken too many Fridays off and i only had 1 friend that was a sahm that could help.

Also in march was time to renew the child support happens every 2 years so I petitioned that he be responsible for his portion. At this time I've covered every cost alone without his help since he said he wouldn't give me one red cent.

Hearing in April he didnt attend new order placed.

May his job received new cs orders and he flipped out saying he didn't get any notification etc... His first time in the middle may he called the preschool 5x in 1 day asking numerous questions, cost hours etc.

He went out and hired a lawyer and is fighting asking for the order to be vacated. I don't have cash for a lawyer therefore I'm getting all my stuff ready.

What are the chances that 2 months shy of my lo turning 5 that they will vacate the order and tell me that he doesn't agree to pay the preschool and I'll be on my own if I choose to keep her there vs sending her to her gma's where she won't be learning anything or interacting with any other kids at all.

Next fall since she misses the cut off her birthday is October and cut off is end of August you have to be 5

Keeping her there is in the child's best interest.

I don't think you have to worry. You got a default judgement because he didn't show up to court but even if he had shown up he's still responsible for helping with the cost of her education. Unless you put her in some top notch preschool that was abnormally expensive I don't see how he would have grounds to object to the decision.

Okay....then she definitely should be in pre-school!

Can you get something in writing from your daughter's teacher talking about how well she is doing in school, how she socializes, etc.?

Yes I already did so attached with leading plan and some of the work she does.
