Custody?

How can I get full legal custody of my sons if their father is in jail?

He's in and out of jail all the time, this time I think he may be gone for a while.
He's a felon and just got a DUI with possession of a firearm. I believe he was still on probation in FL. I heard it was just a BB gun but I don't know for sure because I don't talk to him. He has never had a relationship with the boys. He never even tried to see them until I got a BF, but anyway is it possible? Or should I be okay since he might be gone for a while?

You will have full custody obviously when hes gone, i wouldnt worry about it until he gets out.

He's crazy though, I'm just scared he will show up one day.

I would get it done and over with asap. Why dredge it up in a few months? If he never cared about LO, why would he care now? He only cares when you are in a new relationship- he just wants posession. Get it done and over with and put that in the past.

Unless he signs off his rights you wont be able to get legal custody.

Well getting custody wont stop him from showing up. If you are scared you should get a PPO on him.

I tired to, but he hasn't psychically attacked me since 2009 so the judge denied it.

Well I know that will never happen, he has never cared to be a father. Only ever cared about controlling me and my life.
