Child support

Yesterday I got a letter in the mail from child support. They pretty much said SO and I have court due to the fact he owes some money since he lost his job and recently got a new one. He told them that he got a new job and sent in the info they needed. But now they're saying he could face jail time. He only really "owes" under $100. But when he didn't have a real job, he did little side jobs to get money to help get things for LO. He didn't bother sending the money through child support because it can take weeks for me to see the money.

When we first got child support set up, he was giving me money and they said he didn't owe any support because he was paying even though it was just him giving me money. Do I need to show documentation saying he was helping? Or could I just tell them that he was helping during the time he didn't have a job?

To me, it's beyond dumb to send a parent to jail, while they're working and paying child support, just because they owe a little.

I know in my child support order it states NOT to pay me directly because it WILL NOT count towards child support payments, it will be considered a gift. I really don't know if there is anything you can do about that. Call your case worker and talk to them.

If it doesn't make sense to you, & you two can handle it on your own, why don't you drop the case?

I have daycare assistance and LO has health insurance through the state. If I drop it, they'll drop out help. I didn't even need child support until they told us we had to to even apply for an assistance. It's dumb as hell that it needed to be put in place because SO and I are together and he was giving me more than they ordered. And it didn't take 2 months to see the money

That doesn't make sense. Why would they make you file for child support if you two are together? or did you tell them you weren't together?

We're not married. We're together, but it doesn't matter unless we're married.
