He can do it at the hospital when you file for the birth certificate, or afterwards. In order to get child support you need to establish paternity. After that you should file for sole custody. You can name your child whatever you want. My babies dad did not show up at the hospital. So i gave her my name. A year and a half later, he accepted Paternity, and we changed her name to his. Now a month later he is not visiting her, and I am very sorry that I gave her his name because I feel like he doesn't deserve it. Now I need to ask the court for a change and prove that it is in the best interest of the child. I just want her to have her old name back!! Good luck.
