family and medical leave act 1993?!

posted 18th Jan '08
I  just made a discovery that bothers the crap out of me. I quit my job, came back, and then got pregnant like a month later. I am fortunate that my insurance is working, but what am i going to do about my leave? How much leave should I take? I am fairly sure this means i won't be getting paid while i am gone, but does my employer have the right to let me go when it is time for me to go. I don't think that will happen, but still. This act that protects pregnant women doesn't apply to me in the least since i have technically been employed for less than 12 months now? I am just wondering if my only option in this is to count on not getting payed for my leave, pray that i won't get fired, and sign up for COBRA? what does this mean about adding the little one to my plan, because I have to add him when he is born, right? I am so worried that it all just muddles together, could anyone offer clearheaded advice?

technically an employer doesn't have the right to let you go, but they can let you go and give u a lie for a reason.

You really need to talk to your HR department. They'll be able to help the best...most all companies have different plans and different policys on that, as long as they stay within certain guidelins they can do pretty much wehatever.

You'll have to ask them about getting paid leave. They are not required to pay you, though some do.

They technically cannot fire you while you are on mat. leave. They possibly could when you return, or before you go, but definitely not while you are gone. They are not allowed to fire you for being pregnant. As far as insurance, you are not required to add the baby if you don't want to. You will be insured through the last day you work (in some cases, such as mass layoffs, the company will extend coverage for longer times). Ask your HR department what to do about that. I don't believe you should have to sign up for COBRA whjile out, you will be covered until you come back. If you are released they will have the information on COBRA (whihc is a more expensive form of the same coverage you have now, for former employees who wish to carry that insurance), if you wish to sign up for it.

There is a good chance that you'd be able to put the baby on state medical care (Medicaid), you can either call your state Medicaid office and ask, or the doctor or hospital will have the information for you.

Definitely talk to your HR department though. They'll be able to help you the most. Plus, it doesn't hurt to give them forewarning that you're about to go on leave!
