Actually most states don't consider it rape unless there is a 4+ years age difference. A girls parentstried getting my little bro(he was 19 she was 16)for rape but b/c they were only 3 yrs difference and the girl said it was consentual~sp? there really wasn't anything they would do, which of course pissed her parents off lol. But that was a few years ago and they are now happily married and have given me the cutest nephew  . Now sure about her state though(can't remember where she was from).
